Today’s Consumer Financial Protection Circular explains that when financial institutions charge surprise overdraft fees, sometimes as much as $36, they may be breaking the law. The circular provides some examples of potentially unlawful surprise overdraft fees, including charging penalties on purchases made with a positive balance. These overdraft fees occur when a bank displays that a customer has sufficient available funds to complete a debit card purchase at the time of the transaction, but the consumer is later charged an overdraft fee. Often, the financial institution relies on complex back-office practices to justify charging the fee.

Financial technology or “fintech” innovations use technology to transform traditional financial services, making them more accessible, lower-cost, and easier to use. We champion the power of technology-centered financial services and advocate for the modernization of financial regulation to support inclusion and responsible innovation. But the agency is also taking up initiatives with fintech industry support, including finally setting up open-banking rules to guide data-sharing between financial institutions and tech companies.
First, we expect to propose requiring financial institutions offering deposit accounts, credit cards, digital wallets, prepaid cards, and other transaction accounts to set up secure methods, like APIs, for data sharing. Importantly, a more open market will also make sure consumers won’t have to start from scratch. For example, Americans often use their deposit account history as a life ledger – it is a written record that keeps track of payments and deposits, which can be helpful for taxes, for disputes with merchants, or insurers, and for other purposes. By allowing consumers to transfer their ledger to a new institution, the rule could make switching institutions easier – you won’t need to maintain a relationship with your bank to maintain your written record. If a firm is required to make a person’s financial information available to them, or to a third party acting on the consumer’s behalf, via a secure method, we will be able to mitigate some of the problems that exist today. For instance, individuals who want to switch providers will be able to transfer their account history to a new company, so they don’t have to start over if they are unsatisfied with the service provided by an incumbent firm.

As of the census of 2010, there were 242,803 people, 86,210 households, and 51,898 families residing in the city. The population density was 4,362.8 people per square mile (1,684.4/km2). Norfolk's efforts to revitalize its downtown have attracted acclaim from economic development and urban planning circles throughout the country. Bordered to the west by the Elizabeth River and to the north by the Chesapeake Bay, the city shares land borders with the independent cities of Chesapeake to its south and Virginia Beach to its east. With coastline along multiple bodies of water, Norfolk has many miles of riverfront and bayfront property, including beaches on the Chesapeake Bay.
For example, even when large institutions that share personal data with their customers use APIs, there is no guarantee those institutions don’t play games on availability, latency, and critical data points, like price. These and other successful examples of regulation that decentralize market power are guiding our financial data rights rulemaking. With this in mind, here is what we think a more open and competitive market could look like. The provisions provide for personal financial data rights for Americans, but would only have teeth after the CFPB defined the specifics through rules. When investors are “here today, gone tomorrow,” residents face an uncertain future. But when residents know new businesses are “here today, here to stay,” they can plan for the growth of their communities, provide a stable future for their families, and ultimately become homeowners.
Residents of other geographic areas are included in the results reported for all adults, registered voters, and likely voters, but sample sizes for these less-populous areas are not large enough to report separately. We also present results for congressional districts currently held by Democrats or Republicans, based on residential zip code and party of the local US House member. We analyze the results of those who live in competitive house districts as determined by the Cook Political Report’s 2022 House Race Ratings updated September 1, 2022. These districts are 3, 9, 13, 22, 27, 40, 41, 45, 47, and 49; a map of California’s congressional districts can be found here.
An overdraft fee can become a surprise fee when the customer doesn’t reasonably expect their actions to incur an overdraft fee. For instance, even if a person closely monitors their account balances and carefully manages their spending to avoid overdraft fees, they can easily incur penalties when financial institutions employ processes that are unintelligible or manipulative. Intuit also has constructed its own systems for building and monitoring the immense number of ML models it has in production, including models that are customized for each of its QuickBooks software customers.
